AI Policy for Avatars, Ownership, and Content Creation 

Partnership between NMSU and RealmIQ on Microlearning Using HeyGen

 

1. Purpose and Scope

This policy governs the use of AI-generated instructor avatars, ownership rights, and content creation as it pertains to the microlearning initiatives developed under the partnership between New Mexico State University (NMSU) and RealmIQ, utilizing the HeyGen platform for avatar creation. The policy ensures ethical usage, transparency, and protection of intellectual property for all parties involved in creating and using AI-generated instructor avatars and learning content.

 

2. Avatars and Representation

- Creation of Instructor Avatars: Instructors will be represented through AI-generated avatars created via the HeyGen platform. These avatars will serve as digital stand-ins for instructors during microlearning modules. The avatars will accurately reflect the instructors’ likeness, voice, and mannerisms, while maintaining professionalism and educational appropriateness.

- Your Account, Your Control: Instructors will create and manage their own HeyGen account. RealmIQ and NMSU will not have access to it. HeyGen’s permission structure allows for the authorization by the instructor ONLY and will not use any recordings or personal avatars to train its LLM. - Use Cases: Instructor avatars will be used in interactive tutorials, lectures, and assessments. They will be deployed to improve the accessibility of learning content and to maintain a consistent teaching presence, even in asynchronous or remote settings.

 

3. Ownership of Avatars and Content

- Instructor Avatars: The likeness of the instructors and their AI-generated avatars created on HeyGen will be owned by the individual instructors. HeyGen’s role is limited to the platform and toolset used for the generation of these avatars, while the intellectual property rights of the likeness with the instructors. The content will be owned by RealmIQ under a master services agreement with NMSU granting a non-exclusive right.

- Content: All learning content created for the microlearning modules, including but not limited to videos, lectures, assessments, and interactive exercises featuring the instructor avatars, will be owned by RealmIQ. Ownership rights of any co-created content will be clearly outlined in joint agreements between the instructors and RealmIQ.

- Licensing and Usage: Instructor avatars and associated content will only be used within the approved microlearning modules.

 

4. Content Creation and Integrity

- Transparency: All microlearning modules utilizing AI-generated avatars of instructors must clearly disclose that the instructors are represented by AI avatars created using HeyGen. Learners should be made aware when they are interacting with an avatar rather than a live instructor.

- Academic Integrity: Content created using AI avatars must maintain NMSU’s academic standards. The integration of HeyGen avatars will be carefully monitored to ensure that educational objectives are met without diminishing the integrity of the instruction.

 

5. Data Security and Privacy

- Data Protection: NMSU will ensure that any data related to instructor avatars, learner interactions, and content created through HeyGen is secure and complies with relevant data protection laws, such as FERPA.

- Consent: Instructors must provide explicit consent for the use of their likeness in the form of AI avatars. Likewise, learners must be informed and provide consent for their data to be used in analytics or for educational improvement purposes.

 

6. Review and Amendments

This policy will be regularly reviewed to address new developments in AI avatar technology and content creation. Any changes will be made in consultation with NMSU legal and academic experts, as well as with the input of RealmIQ and the instructors involved.

 

7. Dispute Resolution

In the event of any dispute related to the use of AI-generated avatars, ownership, or content rights, NMSU and RealmIQ will follow an internal mediation process to resolve the matter. If a resolution cannot be reached, legal remedies as outlined in partnership agreements will be pursued.
